WAIVER AND RELEASE OF LIABILITY:

You must be 18 years or older to reserve a seat at a ticketed tea event at The Tea Room at Barnwood Farm, to hold a private party at The Tea Room at Barnwood Farm, or to host a Tea Party to Go by SugarCubes PDX LLC,, otherwise, a parent/guardian must agree to the following terms in writing prior to the beginning of the scheduled party.

In consideration for SUGARCUBES PDX, LLC  (“SugarCubes PDX”) agreeing to allow me to participate in its programs, events, parties or activities, by purchasing a ticket(s) or making a reservation for a private party or Tea Party To Go,  I agree to the following:

I acknowledge that the location of the event, whether offsite or at The Tea Room at Barnwood Farm, whether indoors or outside, may include hazards such as steep stairs, slippery slopes, branches and trees, streams, playground equipment and will always include the presence of hot water. You acknowledge that there are inherent risks associated with the location, either at Barnwood Farm or at an offsite location. You therefore release SUGARCUBES PDX from all liability.

CANCELLATION POLICY:

If, for any reason you should need to cancel a party reservation either at The Tea Room or at an offsite location, we require notification at least 14 days prior to the class start time to issue a full refund. If you cancel with less than 14 days notice, you will receive a  credit toward future events ONLY

RIGHT TO RESCHEDULE

Due to staffing, we reserve the right to cancel ticketed tea events if attendance is below 10 attendees. SUGARCUBES PDX also reserves the right to cancel a party due to bad weather. Notification will be sent at least 4 hours prior to the event and participants will have the option to reschedule. You will have 60 days, if we cancel the party, to reschedule.

PHOTO RELEASE:

I understand that photographs and video images may be taken showing my participation in the programs, events, parties, and activities offered by SUGARCUBES PDX and that SUGARCUBES PDX or its agents, may publish or display on the Internet such photographs and video images for SUGARCUBES PDX’s promotional purposes only. By participating in SUGARCUBES PDX events, I consent to the taking and publication of my photo or likeness for this purposes INCLUDING IMAGES OF ALL PARTY GUESTS.

TO THE GREATEST EXTENT ALLOWED BY OREGON LAW, I HEREBY AGREE TO RELEASE AND DISCHARGE SUGARCUBES PDX, ITS EMPLOYEES, INSTRUCTORS, MEMBERS, MANAGERS, VENDORS AND AGENTS FROM ANY AND ALL RESPONSIBILITY OR LIABILITY FOR ANY INJURY, DEATH, DAMAGE OR LOSS WHICH I MAY SUFFER RESULTING OR ARISING FROM MY PARTICIPATION IN ANY PROGRAM, EVENT, PARTY OR ACTIVITY OFFERED, CONDUCTED OR SPONSORED BY SUGARCUBES PDX, REGARDLESS OF WHETHER OR NOT THE INJURY OR LOSS IS CAUSED BY ANY ACT, OMISSION OR NEGLIGENCE OF SUGARCUBES PDX.

 

I FURTHER AGREE TO INDEMNIFY AND HOLD SUGARCUBES PDX, ITS EMPLOYEES, INSTRUCTORS, MEMBERS, MANAGERS, VENDORS AND AGENTS HARMLESS FROM AND AGAINST ANY AND ALL LIABILITIES, LOSSES, DAMAGES, COSTS AND EXPENSES (INCLUDING ATTORNEYS’ FEES), SUITS, CLAIMS AND JUDGMENTS OF ANY KIND AND NATURE ARISING OUT OF, OR IN CONNECTION WITH ANY INJURY, LOSS OR DEATH THAT IS IN ANY WAY RELATED TO MY INVOLVEMENT WITH OR PARTICIPATION IN ANY PROGRAM, EVENT, PARTY OR ACTIVITY OFFERED CONDUCTED OR SPONSORED BY SUGARCUBES PDX.

I UNDERSTAND AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS INVALID OR UNENFORCEABLE, THE REMAINING PORTIONS OF IT REMAIN IN FULL FORCE AND EFFECT.
 

I AM AT LEAST EIGHTEEN (18) YEARS OF AGE AND HAVE READ THIS AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS BY SIGNING IT.
